General Terms and Conditions (GTC) for the Sale of Banner Advertising and Advertorials on Gotha-Aktuell

1. Scope

These General Terms and Conditions (GTC) apply to all contracts between the website Gotha-Aktuell, operated by Gotha-Aktuell, and the customer regarding the booking of banner advertising and advertorials (guest articles).

2. Description of Services

2.1 Banner Advertising

Gotha-Aktuell provides the customer with advertising spaces on the website where banner ads are displayed in rotation. At the customer’s request, a fixed placement without rotation can be offered for an additional charge of 40%.

2.2 Advertorials (Guest Articles)

The customer can publish sponsored articles (advertorials), which will be marked as such. The content must comply with legal regulations and must not contain misleading information.

3. Conclusion of Contract

3.1 The contract is concluded when Gotha-Aktuell confirms the booking of the banner advertising or advertorial in writing or electronically.

3.2 Gotha-Aktuell reserves the right to reject bookings without providing reasons.

4. Customer Obligations

4.1 The customer undertakes to provide the necessary content and materials for the banner advertising or advertorial in a timely manner, completely, and in the agreed format.

4.2 The customer ensures that the provided content does not infringe on third-party rights and complies with applicable legal regulations, particularly the Telemedia Act (TMG) and the Act Against Unfair Competition (UWG). The customer is responsible for the legal review of the content.

4.3 Links to online gambling are only permitted if they are listed on the official GGL whitelist. Unlisted links will be blocked in Germany using a geo-IP blocker. This does not affect Google indexing.

5. Rights and Obligations of Gotha-Aktuell

5.1 Gotha-Aktuell is entitled to review the content of banner advertising and advertorials before publication. If there are violations of legal regulations or these GTC, publication may be refused or changes may be requested.

5.2 Gotha-Aktuell guarantees the placement of banner advertising and the publication of advertorials within the agreed period and at the agreed positions. Liability for technical failures or delays beyond Gotha-Aktuell’s control is excluded.

6. Prices and Payment Terms

6.1 The prices for banner advertising and advertorials are based on the price list valid at the time of contract conclusion.

6.2 Payment is due within 14 days of invoicing without deductions. In case of late payment, statutory default interest of 9 percentage points above the European Central Bank’s base interest rate will be charged.

7. Liability

7.1 Gotha-Aktuell is only liable for damages caused by intentional or grossly negligent breaches of duty by Gotha-Aktuell, its legal representatives, or agents.

7.2 Liability for the accuracy, completeness, and legality of the content provided by the customer is expressly excluded. The customer indemnifies Gotha-Aktuell from all third-party claims arising from the content.

8. Cancellation

8.1 Once banner advertising, an advertorial, or a guest article has been published, cancellation is no longer possible. The advertisement can be removed at the customer’s request, but no refund will be issued for fees already paid.

8.2 Cancellation before publication is only possible in writing and must be made at least one day before the scheduled publication date.

9. Data Protection

9.1 Gotha-Aktuell undertakes to process the customer’s personal data only in compliance with applicable legal regulations, particularly the General Data Protection Regulation (GDPR). The customer has the right to request access, correction, or deletion of their stored personal data.

10. Final Provisions

10.1 Amendments and supplements to these GTC must be made in writing. No verbal side agreements exist.

10.2 If any provision of these GTC is wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

10.3 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

10.4 The place of jurisdiction for all disputes arising from or in connection with this contract is the registered office of Gotha-Aktuell.
